Please read the terms and conditions of sale prior to placing an order.

Formation of the Contract

1.1 These terms of sale apply to all good supplied by offthetongue (“OFFTHETONGUE LTD,” “we,” “us,” “our.”) Registered business address being Lytchett House, 13 Freeland Park, Wareham Road, Dorset BH16 6FA.

1.2 If you have any questions regarding us, our goods or an order you have placed, please contact us on info@offthetongue.com

1.3 No contract exists between you and OFFTHETONGUE LTD for the sale of any goods until we have received and accepted your order and we send you confirmation in writing via email to the email address you have provided us with.

1.4 We may change the terms of sale without any notice to you in relation to future sales

Description and Price of the Goods

2.1 All goods are subject to availability, including those made to order. Instances may occur when materials for products not yet manufactured may become unavailable. If this affects your order, you will be notified as soon as possible and offered an alternative or a refund.

2.2 In addition to the price, you will be required to pay a delivery charge for the goods.

2.3 All prices are inclusive of 20% VAT but exclude delivery cost. Delivery charges vary depending on location and are subject to change.

Payment

3.1 All payments must be made online via credit card, debit card, or PayPal and you will be responsible for any charges involved in the transaction. If your payment is declined by your bank, your order will not be accepted and we will not be liable for any delay or non-delivery.

3.2 We accept VISA, MasterCard, Maestro and American Express. All orders will be charged in GBP sterling. To securely accept payments online, we use Stripe.

Delivery

4.1 The goods you order will be delivered to the shipping address you provided when your order was placed. You are responsible for ensuring the address is correct. We ship internationally and shipping costs vary. You will be notified of your exact shipping cost at the checkout.

4.2 If there is no one at the address given to take delivery of the goods, you will be notified of the attempt and can collect or rearrange delivery depending on the courier used. The customer is responsible for this and any contact with the courier in that country.

4.3 You will become the owner of the goods ordered once we have received full payment, including delivery charges. You will be responsible for risk of loss or damage to the goods from the time of delivery.

4.4 If someone unauthorised signs for your purchase at the address you have given us, it will not be the responsibility of OFFTHETONGUE LTD.

4.5 Delivery time is subject to product processing time, clearance of your payment and delivery location.

4.6 Please note that any duties and taxes incurred in the country of destination are the responsibility of the client.

4.7 If the parcel is undeliverable and is returned to sender, the customer is liable for the shipping cost for it to be resent. The customer is not entitled to a refund, see 5.2.

Cancellation and Returns

5.1 Every effort is made to assure accurate impression of our products through the OFFTHETONGUE LTD website. However, some images may not be to scale and and the colours shown may vary depending on the individual device and it's screen settings. OFFTHETONGUE LTD reserve the right to change product specifications and prices at any time.

5.2 We regret that we are unable to offer refunds on any product that is manufactured by us due to each article being made to order. Cancellations will be accepted within 24 hours of the order being placed unless we have agreed an accelerated processing time of any kind.

5.3 We accept returns of products that were not made to order within 28 days of purchase. OFFTHETONGUE LTD accepts no liability for postage cost of these items and process a return of monies paid for the item to the buyer within 7 working days.

5.4 If your goods arrive faulty or incorrect, you must let us know in writing within 7 days to info@ofthetongue.com. We will be responsible for the cost of returning faulty or incorrect goods to us.

5.5 Goods returned to us must be in an unused condition with proof of purchase. We cannot be responsible for items returned to us in any other way.

Product Availability

6.1 The website displays product availability. Should a product become unavailable after your order has been placed, we will inform you by email.

6.2 We reserve the right to cancel the contract between you and us if:

a) we have insufficient supplies to create the products you ordered and therefore cannot deliver.

b) we do not deliver to your area.

c) one or more of your items was incorrectly listed in description or price due to an error or incorrect information provided by our suppliers.

6.3 If we do cancel your order, you will be notified via email and monies returned to the card that was used for payment as soon as possible, within 28 days. We will not be obliged to offer any additional compensation for disappointment suffered.

Data Protection

7.1 We will take all reasonable precautions to keep the details of your order and payment secure, but unless we are negligent, we will not be liable for unauthorised access to information supplied by you.

7.2 We will use the information you provide about yourself for the purpose of fulfilling your order. You can correct any personal details or ask for your personal details to be deleted by giving us written notice at info@offthetongue.com

Unforeseen Events

8.1 In the event of the normal course of manufacture of the goods or performance being prevented, interrupted, hindered or delayed by any cause whatsoever beyond our control, we shall have the option without incurring liability to you, to defer the date of delivery.

Sub-contracting

9.1 We shall be entitled to sub-contract the supply of goods and the performance of any services in relation to your goods.

Intellectual Property

10.1 All worldwide intellectual property including any copyright, registered or unregistered design rights in and relating to the goods including any blueprints, designs, drawings, illustrations, specifications and instructions prepared by us in connection with the order, shall vest in us unless set out by express agreement in writing.

Applicable Law

11.1 These terms of sale and the supply of goods will be subject to English law, and the English courts will have jurisdiction in respect of any dispute arising from the contract.
